Connected Device and App Data Access Notice – EU Data Act

placed on the EU market.

Purpose of this Notice

This notice explains how SharkNinja Germany GmbH, Rotfeder-Ring 9, 60327 Frankfurt am Main, Germany, enables access to data generated by your connected device in accordance with the EU Data Act (Regulation (EU) 2023/2854).

It supplements our Connected Devices Privacy Notice, which covers the processing of personal data under the GDPR.

What Data Is Collected or Generated

We only collect the data necessary to ensure your products function correctly, support your use of them, and help us develop and improve our current and future products.

Connected Devices – Operational Data and Diagnostic Data

This data includes, in particular:

  • Sensor Data: device status, obstacle detection or layout mapping area data.
  • Consumables Data: filter life, battery level.
  • Fault & Troubleshooting Data: error codes, warnings, self-diagnostic logs, cloud connect/disconnect events, maps, cleaning reports, cleaning statistics.
  • Usage Data: on/off times, duration of use, selected device settings or modes, docking/undocking events.
  • Battery Management Data: charging status, battery charge level, estimated remaining runtime or low battery alerts.
  • Personalisation Data: language preferences or other preferences set within the connected product.

Some data, such as sensor readings and device status, is generated and transmitted continuously or in real time while the machine is in use. Other data is logged periodically or upon specific user actions or events, such as starting a cleaning cycle or reporting a fault.

SharkNinja App

This data includes, in particular:

  • Personalisation Data: saved schedules, cleaning preferences, areas added or customised to clean or not clean.
  • Usage Data: only enabled if opted in – phone data, interactions within the app, success rate of operations interacting with the cloud or device.
  • Diagnostics: crash logs and error reports.

Data is updated in real time as you interact with app features or synchronise with the connected machine. Manual entries, for example profile updates or schedule changes, are recorded instantly within the app.

Data Storage

Data is stored in structured digital formats such as CSV. Data varies by product, feature, and user activity, and is limited to what is necessary to provide operation, support and personalisation.

Data Retention

Product-generated data is retained for as long as required to support device functionality, maintenance, or as legally required. Data shared with authorised third parties is deleted or anonymised once the purpose of access is fulfilled.

Who Can Access the Data

Under the Data Act, the following may access the product-generated data:

  • You, through your app;
  • Authorised third parties, such as repairers, distributors, or service partners that you nominate or that are engaged by us to support warranty, maintenance, or safety activities.

Access is provided on fair, reasonable, and non-discriminatory (FRAND) terms.

How You Can Access Your Data

Certain data, such as usage information, is accessible through the SharkNinja App within the Account / Data Management settings. Where any of this data can identify you, we treat it as personal data and process it in line with our Privacy Notice.

You can request a copy of your product data via our webform or by emailing [email protected]. If you authorise a third party, we will verify their identity and provide access through a secure transfer method in accordance with applicable laws. Access will be limited to the data necessary for the agreed purpose, for example repair or troubleshooting.

Sharing and Transferring Data

We will transfer data securely using appropriate technical methods to protect your data. Third parties selected by you to receive data related to your device will be required to agree to contractual safeguards, including confidentiality, deletion, and prohibition of onward disclosure. Trade-secret and intellectual-property information are protected, and we may withhold elements that could reveal protected technology in accordance with applicable laws.
